By installing, using, or creating a copy of this software, you accept this License Agreement.
1. Right of use
Sonova Consumer Hearing GmbH (hereinafter “Sonova CHB”) grants you a non-exclusive and non-transferable right to use the software and related documentation provided under this License Agreement to administer and control Sonova CHB products intended solely for this purpose. Without a separate written license agreement, it is not permitted to use the software for the administration or control of other hardware than that of Sonova CHB.

Proprietary ownership of the software and all related intellectual property including – but not limited to – modifications, improvements and revisions of the software remains with Sonova CHB and/or its licensors. Modifications, reverse engineering or decompilation of the software is only permitted if there is a legal or contractual entitlement to do so. In addition to the rights granted under this License Agreement, in particular with regard to trademarks or trade names of Sonova CHB, no further rights are transferred or granted under this License Agreement.

It is known that, according to the current state of the art, it is not possible to create software completely free of errors. In terms of its properties, the software complies with the product specification and product information issued by Sonova CHB. Sonova CHB does not give any warranty for properties that go beyond the extent of their contractual applicability.
If you use the software as an entrepreneur, the warranty period is limited to 1 year.
4. Limitation of liability
In the case of negligent breach of essential contractual obligations, Sonova CHB is liable up to the amount of the foreseeable damage typical for the contract.
In addition, Sonova CHB is liable for damage resulting from grossly negligent or intentional behavior, insofar as the damage relates to the life, body or health of a person or if Sonova CHB has provided a guarantee for the performance of duties or if liability is determined by the product liability act.
Furthermore, Sonova CHB is liable insofar as essential contractual obligations are violated, whereby essential contractual obligations are those which make the proper execution of the contract possible and on whose fulfillment you can trust accordingly.
For the purpose of limiting possible harm, the user is advised to protect his own data processed by the software from loss, even independently of the software, and this recommendation does not affect the liability according to the aforementioned paragraphs of this section 4.
5. Termination of this Agreement
This Agreement is effective until terminated. The termination can be made by the complete and unconditional uninstalling and deletion of the software or destruction of your respective data media or taking out of operation of the device. Sonova CHB will terminate this Agreement immediately and without notice as soon as you violate any of your obligations under this Agreement. In any event of termination of the Agreement, you must uninstall the software and permanently delete or destroy any copies of the software or take the device out of operation.
6. Choice of law and jurisdiction
Insofar as you are an entrepreneur, German law applies to the relations resulting from or in connection with this Agreement, excluding the UN Sales Convention. In this case, the place of jurisdiction shall be the competent court at the seat of Sonova CHB.
